Welcome to Serene Sound, a sleep wellness application designed to help you improve your sleep quality through personalized insights, calming soundscapes, guided breathing exercises, bedtime stories, and mindful journaling. This User Agreement ("Agreement") governs your use of the Serene Sound mobile application ("App"), provided by Serene Sound ("we," "us," or "our"). By accessing or using the App, you agree to be bound by the terms of this Agreement. If you do not agree to these terms, do not use the App.
Serene Sound does not require you to create an account or provide personal identification information to access the core features of the App. You may use the App anonymously, and all sleep logs, journal entries, and preferences will be stored locally on your device. However, certain optional features may require you to provide additional information, which will be governed by our Privacy Policy.
All content, features, and functionality available on the App, including but not limited to text, graphics, logos, soundscapes, breathing techniques, bedtime stories, and software, are the exclusive property of Serene Sound or its licensors and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on the App without our prior written consent.
The App is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the App's accuracy, reliability, or suitability for your specific needs. The sleep insights and recommendations provided by the App are for informational purposes only and are not a substitute for professional medical advice, diagnosis, or treatment. Always consult a qualified healthcare provider before making any changes to your sleep routine or health regimen.
In no event shall Serene Sound be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of the App, including but not limited to loss of data, sleep disturbances, or health complications. This limitation applies regardless of the theory of liability, whether in contract, tort, or otherwise, even if we have been advised of the possibility of such damages.
We reserve the right to modify or update this Agreement at any time. Any changes will be effective immediately upon posting the revised Agreement within the App. Your continued use of the App after the posting of changes constitutes your acceptance of the revised terms.
This Agreement shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any disputes arising from this Agreement shall be resolved in the state or federal courts located in California.
